User Agreement / Terms of Service

Agreement
This User Agreement ("Agreement") is a binding contract between you and BB Writer ("BB Writer", "we", "us"). By creating or using a BB Writer account you agree to this Agreement, the Privacy Notice and the Acceptable Use and Security policy, which are incorporated by reference. If you do not agree, do not use BB Writer.
Eligibility
You must be at least 18 years old, or the age of majority where you live, to create an account. TODO (pending review): decide whether users aged 13–17 may use BB Writer with parental consent.
Your account
You are responsible for activity on your account and for keeping your sign-in credentials private. Do not share your account or use another person’s account.
Your work
You keep ownership of the manuscripts and other content you create. You give BB Writer only the permission needed to store, process and display that content so the service can work for you.
Plans and billing
New accounts start with a 72-hour trial. After the trial, writing is read-only until you buy a plan. Payments are processed by Base44 Payments. Pro Studio Multi-Device is not yet available. TODO (pending review): refund policy and cancellation terms.
AI features
AI suggestions can be inaccurate. Review AI output before relying on or publishing it. You are responsible for what you publish.
Desktop app and devices (planned)
A signed desktop app for macOS, Windows and Linux is planned but not yet available. When available, you can see every device linked to your account and remove any device at any time from your Dashboard or Account page. The current web app does not register devices.
Termination
You may stop using BB Writer and close your account at any time. We may suspend or terminate access for violations of this Agreement as described in the Acceptable Use and Security policy, with notice where reasonably possible and a right to appeal. Sections that by their nature should survive termination (ownership, disclaimers, limitation of liability and dispute resolution) survive.
Disclaimer of warranties
BB Writer is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not guarantee the service will be uninterrupted or error-free. Keep your own backups of important work. Nothing in this Agreement limits rights you have under consumer-protection laws that cannot be waived.
Limitation of liability
To the fullest extent permitted by law, BB Writer is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill. Our total liability for any claim is limited to the amount you paid BB Writer in the 12 months before the claim arose. Some jurisdictions do not allow these limits, so they may not apply to you.
Governing law
This Agreement is governed by the laws of the State of New Mexico, without regard to its conflict-of-laws rules.
Dispute resolution
Please contact support first; most concerns can be resolved informally. If a dispute is not resolved within 30 days of written notice, both parties agree to attempt good-faith mediation in Rio Rancho, New Mexico, before filing suit. If mediation does not resolve the dispute, it shall be brought exclusively in the state courts serving Rio Rancho, New Mexico (Thirteenth Judicial District Court, Sandoval County), and both parties consent to that venue. Either party may bring an eligible claim in small-claims (magistrate) court. TODO (pending review): confirm mediation provider, cost allocation and venue wording with a New Mexico attorney.
General
If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign this Agreement without our consent. This Agreement is the entire agreement between you and BB Writer about the service.
Changes
If we make material changes we will show you the new version and ask you to accept it before you continue. Prior versions remain available on this page.
